Rental terms and conditions

This is an English translation for convenience. The Polish version of these terms is legally binding.

These Terms and Conditions set out the rules for renting bikes and using the car park operated by “u Magdy bike rental and car park” in Siwa Polana, 400 m before the entrance to the Chochołowska Valley (Dolina Chochołowska). Entering into a rental agreement means accepting the provisions of these Terms and Conditions.

§1. General provisions

  • Rental — Magdalena Komperda Parking, NIP 7352426262, REGON 123104218, registered address: ul. Sikorskiego 17/1, 34-400 Nowy Targ; rental point located in Siwa Polana, 400 m before the entrance to the Chochołowska Valley. Contact: tel. 519 107 729, e-mail: imadzia@onet.pl.
  • Customer — a natural person, legal person or organisational unit that enters into a bike rental agreement with the Rental.
  • Equipment — a bike (mountain, electric, electric full or electric children’s) together with accessories (helmet, lock), issued to the Customer for the duration of the rental.
  • Booking — confirmation of the availability of the Equipment for the indicated date, made by phone or online via the SlotWise system.

§2. Rental rules

  • The Rental is open daily in season from 6:00 to 18:00.
  • A bike can be rented on the spot straight away or booked in advance — by phone (519 107 729) or online through the booking system (SlotWise), available 24/7. At weekends and during the summer holiday season we recommend booking in advance.
  • With every bike, the Rental provides a helmet in the appropriate size (children’s helmets too) and a lock — at no extra charge.
  • Children use the Equipment only under the supervision and responsibility of an adult.
  • Bikes are returned during the Rental’s opening hours. If the Customer returns from the trail after 18:00, they should notify the staff at the time of rental — a convenient way to return the Equipment after hours will then be arranged.
  • The Rental offers free delivery of electric bikes within a radius of up to 15 km when renting 2 or more units. Details and delivery availability are confirmed by phone.

§3. Price list and payments

  • Rental fees are set out in the current Price list available at the Rental and on the website.
  • Rental time is counted from the moment the Equipment is handed over until it is returned, in accordance with the pricing options indicated in the Price list.
  • Payment can be made in cash or by card on the spot, and for online bookings — electronically via the SlotWise system.

§4. Customer obligations and safety rules

  • The Customer undertakes to use the Equipment for its intended purpose and in accordance with traffic safety rules.
  • Riding with a helmet (provided in the rental price) is recommended; for children, wearing a helmet is mandatory.
  • Using the Equipment under the influence of alcohol or other intoxicants is prohibited.
  • On the trail, pedestrians have right of way, and the rules for movement within the Tatra National Park and trail signage must be observed.

§5. Liability for equipment, breakdowns and damage

  • The Customer is liable for the entrusted Equipment from the moment it is handed over until it is returned and undertakes to return it in a condition that is not impaired, allowing for normal wear and tear.
  • In the event of a breakdown or damage to the Equipment on the trail, the Customer should contact the Rental immediately by phone (519 107 729). Repairing the Equipment on one’s own without arrangement with the Rental is prohibited.
  • While parked, the Customer is obliged to secure the bike using the lock provided.
  • For damage caused through the Customer’s fault that goes beyond normal wear and tear, and for loss of the Equipment, the Customer is liable on the general terms arising from the provisions of law.

§6. Online bookings and the right of withdrawal

Online bookings are handled by the external SlotWise system. Pursuant to Article 38(12) of the Consumer Rights Act, the right to withdraw from a distance contract does not apply to contracts for the provision of rental services where the contract specifies a day or period for the provision of the service. Please arrange any changes or cancellations of a booking date with the Rental by phone.

§7. Complaints

Complaints regarding the rental or the quality of the Equipment can be submitted by phone on 519 107 729 or to the e-mail address imadzia@onet.pl. Complaints are handled without undue delay, no later than within 14 days of receipt.

§8. Personal data

The controller of Customers’ personal data is Magdalena Komperda Parking. Data is processed for the purpose of fulfilling the booking and the rental agreement (Article 6(1)(b) GDPR). Detailed rules for data processing and the rights available to the Customer are described in the Privacy policy.

§9. Final provisions

  • In matters not regulated by these Terms and Conditions, the provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
  • The Rental reserves the right to amend these Terms and Conditions; the current version is always available at the Rental and on the website.
  • These Terms and Conditions are effective from 9 July 2026.
